Terms and Conditions for XCeleration

Introduction
These Terms and Conditions ("Terms") govern your use of the XCeleration mobile application ("App"), provided by XCeleration ("we", "our", or "us"). By downloading, installing, or using our App, you agree to be bound by these Terms.
Acceptance of Terms
By using the XCeleration App, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
App Usage
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms.
User Responsibilities
- Provide accurate information when using the App
- Ensure all race data entered is accurate and does not violate any laws or regulations
- Maintain the security and confidentiality of your account credentials
- Not use the App in any manner that could damage or impair the App's functionality
Third-Party Services
Google Services Integration
The App integrates with Google services (specifically Google Sheets and Google Drive) to provide enhanced functionality:
- Authorization: When you use Google features within the App, you will be asked to authenticate with your Google account and grant specific permissions.
- Google's Terms: Your use of Google services through our App is subject to Google's Terms of Service and Privacy Policy.
- Legal Rights: We have received appropriate authorization from Google to integrate their services within our App through their developer APIs.
- Limited Access: We only request the minimum permissions needed to provide the functionality you request (creating and managing Google Sheets with your race data).
- Data Handling: Any data transferred to Google services is subject to Google's data handling practices.
- Revoking Access: You may revoke our App's access to your Google account at any time through your Google Account settings.
Intellectual Property
Our Rights
The App, including but not limited to its design, graphics, code, content, and organization, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our explicit permission.
Your Rights
You retain all rights to your race data. By using our App, you grant us a non-exclusive license to use, process, and display your data solely to provide and maintain the App's functionality.
Privacy Policy
Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.
Modifications to the App and Terms
We reserve the right to modify or discontinue, temporarily or permanently, the App or any features within the App at any time with or without notice.
We may update these Terms from time to time. The updated version will be effective as soon as it is accessible. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
